For novice drivers and for those driving without ever having held a driving licence, the limit is lower: 88 micrograms per liter or 0.2 per mille (Article 8, paragraphs 3 and 4 of the Road Traffic Act 1994).

The penalty that follows depends primarily on the level of the measurement and on previous cases in the preceding five years. Below, you can read what penalty the Public Prosecution Service (OM) demands according to its guidelines, when you receive a summary penalty order, and when the judge makes a decision. We also explain when your driving licence is revoked and what the CBR can do in addition.

What exactly does Article 8 of the Road Traffic Act 1994 prohibit?

Article 8 of the Road Traffic Act 1994 prohibits driving a vehicle under the influence of alcohol, drugs, or medication. The law uses fixed limits for alcohol and for a number of drugs, and a general standard for other substances.

Article 8, paragraph 1: You may not drive under the influence of a substance which you know or reasonably ought to know may impair your driving ability. This also applies to medicines.

Article 8, paragraph 2: the alcohol limit of 220 µg/l breath or 0.5 per mille blood for experienced drivers.

Article 8, paragraphs 3 and 4: the lower limit of 88 µg/l or 0.2 per mille for novice drivers and for those driving a motor vehicle without a driving licence.

Article 8, paragraph 5: fixed limit values for drugs such as cannabis, cocaine, and amphetamine, since July 1, 2017.

The ban applies to every vehicle, including bicycles. For cyclists, according to the Public Prosecution Service guidelines, the penalty is a fine of €200 for a first offense, without a driving ban. The full text of the law can be found at wetten.overheid.nl.

Who qualifies as a novice driver?

You are a novice driver during the first five years after you obtained your first driving licence. If you obtained your first AM (moped) or T (tractor) driving licence before the age of eighteen, that period lasts seven years (Article 8, paragraph 3 of the Road Traffic Act 1994).

For a B driving licence that you obtained via 2toDrive before your eighteenth birthday, the same paragraph contains a separate rule. In our article about novice drivers and alcohol we will further elaborate on the timelines and consequences.

What penalty does the Public Prosecution Service demand for driving under the influence?

The Public Prosecution Service applies fixed sentencing guidelines from the Guidelines for prosecution of driving under the influence of alcohol and/or drugs and driving during a driving ban (2019R013). These guidelines have been in effect since January 1, 2020, and will still be in force in November 2026.

The guideline categorizes measurements into scales. Each scale carries a fine, and from a certain level, an unconditional driving ban. For an experienced driver without prior offenses, the following principles apply, among others:

Breath alcohol (µg/l)

Blood alcohol (per mille)

Public Prosecution Service starting point for first offense

235 – 350

0.54 – 0.80

fine €300

355 – 435

0.81 – 1.00

fine € 425

440 – 500

1.01 – 1.15

fine €550

505 – 570

1.16 – 1.30

fine € 650

575 – 650

1.31 – 1.50

fine of €650 and a 4-month ban

655 – 715

1.51 – 1.65

fine of €750 and a 6-month ban

790 – 865

1.81 – 2.00

fine of €950 and an 8-month ban

1,025 – 1,090

2.36 – 2.50

60 hours of community service and a 12-month driving ban

from 1,500

from 3.46

100 hours of community service and a 22-month driving ban

The table is a selection from sixteen scales. For novice drivers, the table starts at 95 µg/l (0.22 per mille) with a fine of €300. From 355 µg/l (0.81 per mille), an unconditional driving ban of two months is added.

These amounts are starting points. The public prosecutor and the judge may deviate based on the circumstances.

What does recidivism mean for the sentence?

If you have already been dealt with for driving under the influence in the five years preceding the new offense, the Public Prosecution Service applies stricter columns of the guideline. In the case of multiple recidivism, the case is generally referred to the court.

Even without prior cases, the sentence may be higher. According to the guideline, the recidivism column applies in cases of dangerous driving and involvement in an accident resulting in more than minor damage or injury; in the latter case, a summons is issued.

In addition, Article 123b of the Road Traffic Act 1994 provides for a recidivism scheme. If you are irrevocably dismissed twice within five years for driving under the influence or for refusing an alcohol test, and the second measurement was above 570 µg/l (1.3 per mille), your driving licence becomes invalid by operation of law. You must then retake the exam.

On October 27, 2026, the House of Representatives adopted the bill on improving the approach to driving under the influence (36586). That proposal repeals Article 123b and gives the judge, among other things, the power to declare the driving licence invalid. The proposal is currently before the Senate; until it enters into force, the current regulations remain in effect.

Will you receive a summary penal order or do you have to attend the hearing?

For lower blood alcohol levels and a first offense, the Public Prosecution Service usually settles the case with a Public Prosecution Service summary penal order. In the case of higher blood alcohol levels, recidivism, or an accident, a hearing with the Public Prosecutor or a summons to appear before the police judge follows.

A summary penal order may include a driving ban of up to six months. If a longer ban is applicable, the judge will decide. If you disagree with a summary penal order, you may lodge a written objection within 14 days of receipt. The criminal court will then hear the case again. You can read more about this in our article on the traffic penalty notice.

The statutory maximum is well above the guideline. Since January 1, 2020, this has been a prison sentence of one year or a fine of the fourth category. In addition, the judge may impose a driving ban of up to five years, and for repeat offenses, up to ten years.

When do the police immediately confiscate your driver's license?

The police will confiscate your driving licence if your breath alcohol level exceeds 570 µg/l (1.3 per mille). For novice drivers, that limit is 350 µg/l (0.8 per mille), in accordance with Article 164 of the Road Traffic Act 1994 and the Public Prosecution Service instruction on the confiscation of driving licences (2022I004).

The public prosecutor decides within ten days whether your driving licence will be withheld or returned. In the case of an offence such as driving under the influence, the hearing must begin within six months; otherwise, you will get your driving licence back. You can read more about how this proceeds in our article about a confiscated driver's license.

What measures can the CBR impose?

In addition to the criminal case, the police report the case to the CBR, which may impose its own measure pursuant to Article 130 of the Road Traffic Act 1994. This measure is separate from the sentence and is therefore in addition to it.

Minor educational measure alcohol and traffic (LEMA): from 0.8 per mille (350 µg/l) for experienced drivers and from 0.5 per mille (220 µg/l) for novice drivers.

Educational measure alcohol and traffic (EMA): from 1.0 per mille (435 µg/l) for experienced drivers and from 0.8 per mille (350 µg/l) for novice drivers. According to the CBR Tariffs Regulation 2026, the EMA costs a total of €1,197.

Fitness assessment: from 1.8 per mille (785 µg/l) for experienced drivers and from 1.3 per mille (570 µg/l) for novice drivers.

The CBR can also impose an EMA if you have been stopped twice within five years, or if you refused the breathalyzer test. If you do not comply with or pay an imposed measure, your driving licence will become invalid. You can find an overview of all sanctions at penalties and measures in traffic criminal law.

What can we do for you regarding driving under the influence?

We assess the measurement, the procedure, and the application of the guideline. We can:

check the official report and the breathalyzer, including the waiting period of twenty minutes and the validity of the measurements;

verify whether the Public Prosecution Service has selected the correct scale and the correct recidivism column;

to object to a penal order on your behalf;

assist you at a public prosecutor's hearing or before the police judge;

request the court to order the return of your withheld driving licence;

advise you regarding the combination of the criminal case with a CBR measure.

Summary

The limit is 220 µg/l or 0.5 per mille; for novice drivers 88 µg/l or 0.2 per mille (Article 8 of the Road Traffic Act 1994).

The Public Prosecution Service demands a sentence in accordance with guideline 2019R013: from a €300 fine to community service and a driving ban of nearly two years.

A penal order may include a ban of up to six months; an objection may be lodged within 14 days.

Your driver's license will be confiscated above 1.3 per mille (0.8 for beginners).

The CBR can impose a LEMA, EMA, or a fitness-to-fit assessment, separate from the penalty.

Frequently Asked Questions

From which measurement does the OM table start?

The law prohibits a level higher than 220 µg/l or 0.5 per mille. The Public Prosecution Service's sentencing scale starts at 235 µg/l (0.54 per mille) for experienced drivers and at 95 µg/l (0.22 per mille) for novice drivers.

Does a previous penal order count as recidivism?

Yes, the guideline looks at previous dispositions in the five years preceding the new offense, and a penal order falls under that. The recidivism scheme of Article 123b of the Road Traffic Act 1994 also refers to irrevocable dispositions, not only judgments.

Will I always receive a CBR measure?

No. An experienced driver only receives a measure upon a first arrest starting from 0.8 per mille; a novice driver from 0.5 per mille. In the event of a repeat offense within five years or refusal, the CBR can impose a course even at lower values.

Questions about your case?

Email us a few sentences explaining what
