If you use multiple drugs or drugs together with alcohol, much lower limits apply, which in practice amount to the lowest measurable quantity.

For other drugs and medicines, there are no limit values. For these, Article 8, paragraph 1 of the Road Traffic Act 1994 applies: you may not drive under the influence of a substance which you know or reasonably ought to know can impair your driving ability. Below you can read how both rules work, how the police test, and what penalties and CBR measures may follow.

What is the difference between Article 8, paragraph 1 and paragraph 5?

Article 8, paragraph 5, works with fixed limits: above the limit, you are punishable, regardless of how you drove. Article 8, paragraph 1, requires proof that you were under the influence to such an extent that your driving ability could have been impaired, and that you knew or ought to have known this.

Paragraph 5 applies to twelve substances designated in the Decree on Alcohol, Drugs and Medicines in Traffic. For all other substances, such as many medicines, prosecution falls under paragraph 1. The Public Prosecution Service then substantiates this, for example, with driving behavior, physical characteristics, and test results.

What limit values apply per substance?

The limit values are set out in Article 3 of the Decree on Alcohol, Drugs and Medicines in Traffic and are measured in the blood. The decree specifies a value for the use of a single substance and a lower value for combined use.

Dust

Limit value for a single substance

Limit value for combination

Cannabis (THC)

3.0 µg/l

1.0 µg/l

Cocaine

50 µg/l

10 µg/l

Amphetamine, methamphetamine, MDMA, MDEA, MDA

50 µg/l

25 µg/l

Heroin and morphine (measured as morphine)

20 µg/l

10 µg/l

GHB, GBL and 1,4-butanediol (measured as GHB)

10 mg/l

5.0 mg/l

Alcohol in combination with drugs

–

0.2 per mille

For amphetamine-like substances, when multiple substances are used, the sum of the concentrations also counts. The table provides a simplified picture; for your case, the text of the decree as it applied on the day of the arrest applies.

What applies to combined use?

When drugs are combined with other drugs or with alcohol, the lower limit values set out in Article 3, paragraph 2 of the Decree apply. According to the explanatory notes, these are analytical limit values: the lowest reliably measurable quantity, because the risk increases significantly with combinations.

For alcohol in combination with drugs, a limit of 0.2 per mille applies, even if you are an experienced driver. The national government refers to this as a zero limit. Combined use is also punished more severely than the use of a single substance, as shown below.

How does the police determine drug use?

The police may require you to cooperate with a saliva test or an examination of your psychomotor functions and your eye and speech functions (Article 160, paragraph 5 of the Road Traffic Act 1994). In the event of a positive indication, a blood test will follow (Article 163 of the Road Traffic Act 1994).

The saliva test is a selection tool. Not every substance can be measured with it; the explanatory notes to the decision cite GHB as an example.

The blood must be drawn no later than one and a half hours after the request for cooperation, unless there are special circumstances (Article 12, paragraph 3 of the Decree).

An accredited laboratory examines the blood. According to the central government, the results usually take about a month.

After the result, you can have a counter-examination performed at your own expense.

Refusing to cooperate with the investigation is in itself a punishable offense and is severely punished by the Public Prosecution Service. You can read what the police are allowed to ask at obligations and cooperation.

Are you allowed to drive if you take medication?

As a rule, medicines fall under Article 8, paragraph 1 of the Road Traffic Act 1994. The Public Prosecution Service assumes that you have read the label and the package leaflet; if it states therein that the medication affects driving ability, this counts as a warning.

If you use prescription medication, the Public Prosecution Service (OM) requests a prescription or a statement from your doctor. According to the OM, prosecution will follow, for example, if there is no prescription, if you took more than prescribed, or in combination with alcohol or drugs. Driving after using dexamphetamine, morphine, or medicinal cannabis in combination with alcohol or drugs is always punishable, according to the OM.

Please note: according to the explanatory notes to the decision, the limit value for morphine also applies if you use prescription morphine. You can find more information on the Public Prosecution Service's page regarding medication and traffic.

What penalty does the Public Prosecution Service demand for drugs in traffic?

The Public Prosecution Service also uses the Guidelines for the prosecution of driving under the influence (2019R013) for drugs. For a driver without prior cases, these principles apply:

Use of a single substance above the limit value: fine €850.

Combined use: 50 hours of community service and a 9-month unconditional driving ban.

Refusal of the investigation: 60 hours of community service and a 6-month driving ban.

Refusal in case of suspected multiple use: 80 hours of community service, 2 weeks of suspended imprisonment, and a 12-month disqualification.

For mopeds, the table starts with a fine of €325, and for bicycles with €250. Penalties are higher in cases of recidivism within five years, dangerous driving, or an accident. The statutory maximum is the same as for alcohol: a one-year prison sentence or a fine of the fourth category, and a disqualification of up to five years, or up to ten years in case of repeat offenses. An overview can be found at penalties and measures.

The recidivism provision of Article 123b of the Road Traffic Act 1994 also applies to drugs: two final and irrevocable convictions within five years can result in your driving licence becoming invalid by operation of law. Legislative Proposal 36586, which the House of Representatives adopted on October 27, 2026, replaces that provision and also stipulates that the driving licence may be confiscated in the event of (a serious suspicion of) combined use of alcohol and drugs. That proposal has not yet entered into force.

What measures can the CBR impose?

The police also report a drug case to the CBR. Since April 1, 2023, the CBR can impose the educational measure drugs and traffic (EMD).

The CBR imposes the EMD if the police report contains information regarding your behavior, appearance, or driving behavior that indicates drug use, and the examination gives no grounds to declare the driving license invalid. An examination of suitability follows, among other things, if you have already undergone an EMD in the five years prior, if there is a suspicion of dependence, or in the case of two police reports within five years. The costs are your responsibility. You can read more about the examination at suitability assessment.

What can we do for you regarding driving under the influence of drugs?

We assess whether the saliva test and the request for a blood test were lawful.

We check whether the blood was drawn within the one and a half hour timeframe.

We compare the result with the limit values that applied on the day of the arrest.

In the case of medication use, we assess whether Article 8, paragraph 1 or paragraph 5 applies.

We advise on a counter-investigation and the timeframe thereof.

We assist you before the Public Prosecution Service, the court, and, if necessary, the CBR.

Summary

Since July 1, 2017, fixed limit values apply to twelve substances (Article 8, paragraph 5 of the Road Traffic Act 1994).

For combined use, much lower limits apply, 0.2 per mille for alcohol.

For medicines and other substances, Article 8, paragraph 1 applies: impaired driving ability and knowledge.

The Public Prosecution Service demands a fine of €850 for a single substance, and community service and a 9-month driving ban for combined use.

The CBR can impose an EMD or an assessment of fitness to drive.

Frequently Asked Questions

How long after use am I still above the limit value?

That cannot be stated in general, because it varies by substance, quantity, and person. There is no reliable timeframe after which you are certainly below the limit value.

Am I liable to prosecution if I take my medication as prescribed?

Not automatically. The Public Prosecution Service then requests a prescription or a doctor's statement and prosecutes, for example, in cases of use without a prescription, an overdose, or combination with alcohol or drugs.

What if the saliva test was positive, but the blood was below the limit?

For a violation of Article 8, paragraph 5, the result of the blood test is decisive. However, the Public Prosecution Service may still prosecute on the basis of Article 8, paragraph 1, if other evidence indicates impaired driving ability.

Questions about your
