If you do not agree with the confiscation or withholding, you may file a notice of complaint with the court in accordance with Article 164, paragraph 8 of the Road Traffic Act 1994.

Below, we explain when the police are authorized to confiscate a license, which time limits apply, when you will get your license back, and what role the CBR plays.

When is the police allowed to confiscate your driver's license?

Article 164 of the Road Traffic Act 1994 grants the police this authority in a limited number of cases. The police then demand the “surrender” of your driving licence: you must hand it over immediately.

The fixed grounds are set out in Article 164, paragraph 2 of the Road Traffic Act 1994 and are elaborated in the Public Prosecution Service Instruction regarding the confiscation of driving licences (2022I004), which has been in effect since 1 September 2022:

Ground

Border

Alcohol, experienced driver

more than 570 µg/l exhaled air or 1.3 per mille in the blood

Alcohol, novice driver

more than 350 µg/l exhaled air or 0.8 per mille in the blood

Refusal of breath or blood test

violation of Article 163 of the Road Traffic Act 1994

Speed, motor vehicle (not a moped)

50 km/h or more too fast, after being stopped

Speed, moped

30 km/h or more too fast, after being stopped

A novice driver is someone who has held a driver's license for less than five years. In cases of speeding, a roadside stop is a requirement: a speed camera photo taken afterwards is not grounds for confiscation. You can read more about alcohol limits in our article about the blood alcohol level.

Can the police also confiscate funds for dangerous driving?

Yes. According to Article 164, paragraph 3 of the Road Traffic Act 1994, the police may also confiscate a ticket if you have seriously endangered road safety through an infringement. There is no fixed limit for this; the Public Prosecution Service instruction cites accidents resulting in death or serious injury and serious speeding violations within built-up areas as examples.

On these grounds, the officer must first consult with an assistant public prosecutor. An accident is not required. See also our article on dangerous driving behavior.

What happens immediately after collection?

The police send your driver's license along with the official report to the Public Prosecutor. According to the Public Prosecution Service instructions, this must reach the Public Prosecution Service within five days.

You may no longer drive from the moment of seizure. Article 9, paragraph 7 of the Road Traffic Act 1994 prohibits driving a motor vehicle as long as surrender has been demanded or the driving licence has been seized and has not been returned. The Public Prosecution Service points out that this also applies to a scooter or tractor. If there is no other driver, the police may take your car into custody pursuant to Article 164, paragraph 7 of the Road Traffic Act 1994.

Within what timeframe does the public prosecutor make a decision?

The public prosecutor must decide within ten days of the confiscation whether to retain or return your driving licence. If he fails to make a decision within that period, the driving licence must be returned in accordance with Article 164, paragraph 6 of the Road Traffic Act 1994.

If the tenth day falls on a weekend or a public holiday, the time limit is extended in accordance with the General Time Limits Act. With regard to grounds for alcohol and speeding, the law assumes a risk of recidivism, unless there are exceptional circumstances. In the event of refusal of a breathalyzer test or in the case of serious danger, the public prosecutor must deduce that risk of recidivism from other facts.

If you wish to get your driving licence back sooner, you can submit a petition to the Public Prosecutor. You must then demonstrate that its return is of great importance to you, for example for your work.

When will you get your confiscated driver's license back?

The Public Prosecution Service instruction lists a number of situations in which the driving license must be returned. The most important are:

the collection was unjustified;

the public prosecutor has not decided within ten days;

there is a serious chance that you will not receive an unconditional disqualification, or a shorter one than the time your driving licence has already been withheld;

in the case of a criminal offence: there is no hearing or penal order within six months (Article 164 paragraph 6 of the Road Traffic Act 1994);

In the event of an infringement: no hearing or summary penal order within four months (Public Prosecution Service's own policy);

The judge in chambers orders return.

Upon return, the Public Prosecution Service will inform you where you can pick up the driving licence, or will send it by registered mail. According to Article 179, paragraph 6 of the Road Traffic Act 1994, the time you spent without a driving licence will be deducted from a later period. driving ban.

How do you object to collection or withholding?

You must file a notice of complaint with the registry of the court in the district where the offense was committed, as long as no prosecution has yet been instituted (Article 164, paragraph 8 of the Road Traffic Act 1994). The court hears the notice of complaint in chambers, a closed session.

In practice, this is also referred to as a notice of objection, but the law calls it a notice of complaint. The judge assesses whether the confiscation was justified and whether the interest of road safety outweighs your personal interest in the return of the license. In doing so, it is taken into account whether the expected disqualification is longer or shorter than the period you have already been without a driver's license.

An example is a decision by the District Court of Overijssel from 2021 (ECLI:NL:RBOVE:2021:2636). The chamber declared the complaint unfounded because there was a risk of recurrence and a subsequent disqualification was not expected to be shorter than the detention. An appeal in cassation against the decision of the chamber lies with the Supreme Court.

What does the CBR have to do with a confiscated driving license?

Following a serious offense, the police often also report you to the CBR pursuant to Article 130, paragraph 1 of the Road Traffic Act 1994. The CBR then assesses, independently of the criminal case, whether you are required to take a course or undergo an examination.

In the event of very high alcohol levels, from 785 µg/l or 1.8 per mille, the police also confiscate the driving licence for the CBR (Article 130 paragraph 2 of the Road Traffic Act 1994 and Article 5 of the Regulation on Measures regarding Driving Proficiency and Fitness 2011). The CBR then suspends your driving licence pending the outcome of an examination of your fitness. In the event of concurrent offenses, criminal confiscation takes precedence, and the driving licence is first sent to the Public Prosecution Service.

If you get your driving licence back from the Public Prosecution Service, that does not always mean you are allowed to drive again. You can read more about the CBR side in our article about suspension and invalidation of the driving license.

What can we do for you if your driver's license is confiscated?

We verify whether the recovery is based on a valid ground under Article 164 of the Road Traffic Act 1994 and whether the time limits have been met.

We will draw up a petition to the Public Prosecutor if you urgently need your driver's license.

We lodge a notice of complaint with the court and plead for restitution in chambers.

We assess the measurement of alcohol content or speed for errors.

We monitor the parallel CBR procedure and coordinate both tracks.

Summary

Confiscation is permitted for, among other things, more than 1.3 per mille (0.8 for beginners), refusing a breathalyzer test, or exceeding the speed limit by 50 km/h (30 km/h for mopeds).

From the date of seizure, you may not drive a motor vehicle (Article 9, paragraph 7 of the Road Traffic Act 1994).

The public prosecutor decides within ten days on withholding or refund.

In the event of a criminal offense, the driver's license must be returned if there is no hearing or summary penalty order within six months.

A complaint against recovery or withholding may be lodged with the court (Article 164, paragraph 8 of the Road Traffic Act 1994).

Frequently asked questions about a confiscated driver's license

Am I allowed to continue driving with a foreign driver's license after it has been confiscated?

No. Article 164, paragraph 1 of the Road Traffic Act 1994 also applies to a foreign or international driving licence, and the driving ban of Article 9, paragraph 7 of the Road Traffic Act 1994 applies to all categories of the confiscated driving licence.

What if the police didn't physically take my driver's license?

In that case too, the driving ban applies as soon as the surrender has been demanded. The Public Prosecution Service instruction stipulates that the demand must reach the Public Prosecution Service within five days, even if the driving license was missing, for example.

Can I receive compensation if I am acquitted later?

That is possible. According to Article 164, paragraph 9 of the Road Traffic Act 1994, the court may, upon request, award compensation at the expense of the State if the case ends without a sentence or with a sentence that does not justify recovery.

Can the CJIB also confiscate my driver's license?

Yes, but that is a different procedure. In the case of unpaid traffic fines, the CJIB can have the driving license confiscated until the outstanding amount is paid.

Questions about your case?

Email us a few sentences explaining what your question is about, via info@lawandmore.nlWe will let you know if we can help you and what the next step is.

This article provides general information and does not replace advice regarding your specific situation.

Driving license confiscated by the police?
